Miranda E. Thomas offers the following 3 license options so that Collectors may choose which license works best for their needs:

Digital Download Personal Use License

The PERSONAL USE License grants you, the purchaser, an ongoing, non-exclusive, worldwide license to make use of the Artist’s work (ITEM) you have purchased. This PERSONAL USE License applies to the following ITEMS:

(a) physical prints; (b) digital download files; (c) print-on-demand.

1.0  Things You Can Do With The ITEM

1.1 You are the End User and have the license to use the ITEM to create as many personal End Products for yourself as you wish.

1.2 An End Product is the ITEM printed on the media of your choice. For example, a mug, t-shirt, paper or canvas.

2.0 Things You Can NOT Do With The ITEM

2.1 You can NOT Sell the End Product.

  • (If you want to Sell the End Product, you will need to purchase a COMMERCIAL License.)

2.2 You can NOT re-distribute the ITEM as stock, in a tool or template, or with source files, either with ITEM alone or bundled with other Items.

2.3 If you modify the ITEM. You can NOT re-distribute NOR make available the ITEM as-is or with superficial modifications. This is NOT allowed even if the re-distribution is given for Free. For example:

  • You can NOT Sell the ITEM or give the ITEM for Free to a client.
  • You can NOT license the ITEM and then make it available as-is on your website for your users to download.

2.4 You can NOT use the ITEM in any application allowing your end user to customize a digital or physical product to their specific needs, such as an “on-demand,” “made-to-order” or “build-it-yourself” application.

  • (If you want to use the ITEM in this way, you will need to purchase a COMMERCIAL License to incorporate the ITEM that is created using the application.)

Examples of “on demand”, “made to order” or “build it yourself” applications: website builders, “create your own” slideshow apps, and e-card generators.

  • (You will need a COMMERCIAL license for each End Product created.)

2.5 You can NOT use the ITEM in a logo, trademark, or service mark.

3.0 General License Terms

3.1 You can ONLY use the ITEM for lawful purposes. Also, if the ITEM contains an image of a person, even if the ITEM has a model-release you can NOT use it in a way that creates a fake identity, implies personal endorsement of a product by the person, or in a way that is defamatory, obscene or demeaning, or in connection with sensitive subjects.

3.2 For any ITEM that contains digital versions of real products, trademarks or other intellectual property which is owned by others has NOT been released. These Items are licensed on the basis of editorial use only. It is your responsibility to consider whether your use of these Items requires a clearance and if so, to obtain that clearance from the intellectual property rights owner.

3.3 This license applies in conjunction with the Miranda Thomas Fine Art Terms for your use of Miranda Thomas Fine Art ITEMS. If there is an inconsistency between this license and the Miranda Thomas Fine Art Terms, this license will apply to the extent necessary to resolve the inconsistency.

3.4 This license can be terminated if you breach it. If that happens, you must stop making End Product(s) containing the ITEM, as well as, remove the ITEM from all existing End Product(s).

3.5 Miranda E. Thomas retains ownership of the ITEM but grants you the license on these terms. This license is between the Miranda E. Thomas and you.

The COLLECTOR PERSONAL USE License grants you, the purchaser, an ongoing, non-exclusive, worldwide license to make use of the art work (ARTWORK) you have selected. Read the rest of this for details that apply to your use of the ARTWORK, as well as the FAQs (which form part of this license).

1.0  Things You Can Do With The ARTWORK

1.1 You are the End User and have the license to display the ARTWORK as you wish.
